Terms of Service

Welcome to GoSites. These Terms of Service ("Terms") govern your access to and use of the GoSites platform, including the website at gosites.polsia.app, the operator dashboard, AI-powered website generation, lead discovery tools, automated outreach features, and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("you," "your," or "the Operator") and GoSites ("we," "us," or "our").

1. Description of Service

GoSites is an AI-powered B2B lead generation and website delivery platform. The Service enables Operators to:

• Discover local businesses with weak or missing websites using automated scraping tools.
• Generate premium website landing pages for those businesses using artificial intelligence.
• Deliver generated websites to leads via email and text message automation.
• Manage client relationships, subscriptions, and billing through an integrated dashboard.

GoSites is a platform tool — you use it to build and run your own website sales business. You are responsible for how you use the leads, generated content, and outreach tools in compliance with applicable laws.

2. Account Registration

To access the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials confidential and not share them with third parties.
• Notify us immediately of any unauthorized access or security breach.
• Be responsible for all activity that occurs under your account.

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Subscription Plans and Billing

GoSites offers the following subscription tiers:

a. Automatic Renewal

Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for all subscription fees.

b. Cancellation

You may cancel your subscription at any time through the dashboard or by contacting us. Cancellation takes effect at the end of the current billing period — you will not receive a refund for any partially used billing period.

c. Failed Payments

If a payment fails, we will attempt to retry the charge. If the payment remains unresolved after 14 days, we may suspend your account until payment is received. You are responsible for any fees incurred by failed payments, including Stripe's standard fees.

d. Price Changes

We may change subscription prices at any time. For existing subscribers, price changes take effect at the start of the next billing cycle after notification. We will provide at least 30 days' notice before any price increase takes effect.

4. Intellectual Property

a. GoSites IP

GoSites and its licensors retain all right, title, and interest in and to the platform, software, technology, branding, logos, and any content we provide (collectively, "GoSites IP"). You are granted a limited, non-exclusive, non-transferable license to use the GoSites IP solely to access and use the Service during your active subscription. You may not copy, modify, distribute, sell, or lease any part of the GoSites IP.

b. Your Content

You retain all ownership rights to the data you input into the Service — including your leads, business information, and any copy you write yourself. You grant GoSites a limited license to use your content solely to provide the Service to you (e.g., to generate and host a website, to send outreach on your behalf).

c. AI-Generated Content

The websites generated by GoSites' AI tools are created for your use in serving your leads. You may use AI-generated websites and their content (copy, design) in connection with your client delivery activities. You may not resell the AI generation capability itself as a standalone product. We do not guarantee that AI-generated content does not infringe third-party rights — you are responsible for reviewing generated content before delivering it to clients.

5. Acceptable Use

You agree to use the Service only for lawful purposes. The following activities are strictly prohibited:

• Using the Service to scrape, collect, or store personal data in violation of applicable privacy laws (including GDPR or CCPA).
• Sending unsolicited commercial messages (spam) to scraped contacts.
• Using the Service to impersonate a business or individual without authorization.
• Uploading malicious code, viruses, or harmful content to the platform.
• Attempting to gain unauthorized access to other users' accounts or data.
• Reverse-engineering, decompiling, or disassembling the platform.
• Using the Service in connection with any fraudulent, deceptive, or illegal scheme.
• Reselling, redistributing, or sublicensing access to the platform without written consent.

We reserve the right to suspend or terminate accounts that violate acceptable use policies, without refund.

6. Disclaimers of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) the results obtained from using the Service will meet your specific requirements; (c) the quality of any information or content obtained through the Service will meet your expectations; or (d) any errors in the Service will be corrected.

You acknowledge that AI-generated content is produced by automated systems and may contain inaccuracies or undesirable content. You are responsible for reviewing all generated content before use.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GoSites, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless GoSites and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your use of any lead data or generated content in violation of applicable law.

9. Termination

You may terminate your account at any time by canceling your subscription through the dashboard or contacting us. We may terminate or suspend your account immediately, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or acted in a manner that harms GoSites or its users.

Upon termination: (a) your right to access the Service immediately ceases; (b) any outstanding subscription fees remain due; (c) we may delete your account data within 90 days of termination, subject to legal retention requirements.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in Wilmington, Delaware. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

11. Modifications to Terms

We may modify these Terms at any time by posting the updated version on this page with a revised "Last updated" date. For material changes, we will also notify you by email to the address associated with your account. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
